Terms of Use for RHS Plants for Pollinators

These Terms of Use apply to the RHS Plants for Pollinators logo (“RHS PfP”).

1.  RHS PfP User: A RHS PfP User is any person or entity permitted to use RHS PfP for a particular plant as set out in these Terms of Use.  A RHS PfP User may be a supplier, breeder, grower, or retailer of a plant (including seeds or seed mix) that is listed in the RHS PfP lists at www.rhs.org.uk “RHS PfP Lists”. Use may include referencing, selling or promoting the relevant plant (including seeds, seed mixes and plant collections).

2. Media Writer: In these Terms a media writer is any person writing about a plant that that is included in a RHS PfP List.

3. The Digital Asset: Where a digital asset of RHS PfP is available, the RHS will provide it to the PfP User and Media Writer. A PfP User and Media Writer must not create their own physical, photographic or digital image for RHS PfP, or anything confusingly similar, or alter any digital asset provided by the RHS. 

4. Use of the Digital Asset:  A RHS PfP User may use the Digital Asset in its own printed and digital marketing materials related to its business, in retail displays relating to its business, and on product labels or packaging.  Examples of prohibited uses include use of the Digital Asset on vehicles, products, uniforms or signage (other than signage within a retail display).  The Digital Asset may only be used in relation to a plant listed in a RHS PfP List and meeting the following criteria:

A. The Digital Asset may be used on the plant and all taxa at the level below that listed on a the PfP List, unless the plant provides significantly reduced floral resources (as outlined in B below);

B. Plants that offer limited access to, or provision of, pollen and/or nectar are excluded, for example, 'double' flowers, where petals are produced instead of the plant organs that support pollinators;

C. For seed mixes, at least 75% of the contents (by volume or seed number) must be listed on RHS PfP Lists. Similarly, for plant collections, at least 75% of plants within the collection must be listed on the RHS PfP Lists;

D. The plant must be grown in a way that minimises pesticide use and complies with all applicable pesticide regulations.

The Digital Asset may not be used with any plant (including seeds, seed mixes and plant collections) that fails to meet the criteria above, or any unlisted plant or other product. 

5. Use of the Digital Asset by a Media Writer: A Media Writer may use the Digital Asset to write about a plant or plants listed in the PfP Lists. The Digital Asset may not used in connection with any unlisted plant or other product. 

6. All other uses are prohibited:  Unless the RHS has given its prior written consent, all other uses of a Digital Asset are strictly prohibited.  A PfP User and Media Writer must not permit, allow or enable any third parties to use a Digital Asset or anything confusingly similar to them.

7. Duration: The RHS PfP Lists are subject to regular review by the RHS Plants for Pollinators Working Group, to make sure that each plant still merits its place on a RHS PfP List. A PfP User may use the Digital Asset until such time as the relevant plant is no longer on a PfP List.  The RHS may update the PfP Lists by publishing revised versions on the RHS website or through other general communications. It is the responsibility of the PfP User to ensure they are using the most current version of the PfP Lists. Once a plant has been removed from a PfP List, the PfP User must immediately cease their use of the Digital Asset in relation to that particular plant.

8. RHS Trade Marks: Use of the RHS’ names, logos or trademarks other than as set out in these Terms of Use is strictly prohibited.

9. Conduct: A RHS PfP User must not do anything that, in the RHS’s reasonable opinion: (a) does not align with the RHS’s current aims, strategy or policies; or (b) may bring the RHS or RHS PfP into disrepute, or damage their reputation or goodwill.

10. Termination of Use: On written notice, the RHS may terminate the rights of a PfP User or Media Writer early under these Terms of Use if the RHS reasonably considers that they have not complied with these Terms of Use, and on receipt of the notice they must immediately cease their use of the Digital Asset.

11. Amendment: The RHS may amend these Terms of Use from time to time.  The RHS will make the current Terms of Use available on the RHS website.  Please check to ensure you comply with the current Terms of Use.
